At InnerCircles LLC (InnerCircles, we, us, or our), we value the privacy of our community of users (users, you, your, creators) across our website, web-app, and services [innercirclesapp.com, innercircles.online, about.innercirclesapp.com]. In this Privacy Policy, we describe the personal information that we collect, how it is obtained, how we use this information; as well as which information may be disclosed and your rights & choices.

Policy Terms

By using our website, web-app, or services, you understand and agree that InnerCircles may collect, use, and disclose your personal information in accordance with this Policy and applicable Terms-and-Conditions. By using our web-app or interacting with our website, you assent to the practices described in this Privacy Policy. InnerCircles reserves the right to change, modify, add, or remove portions of this Policy and relevant Terms at any time. If changes are made to this document, we will inform you by changing the ‘effective date’ of the Privacy Policy, including a notification within our web-app, and/or notifying web-app users via email.

1. Information Collected

Personal Information

By using our website, web-app, or services, you understand and agree that InnerCircles may collect, use, and disclose your personal information in accordance with this Policy and applicable Terms-and-Conditions. By using our web-app or interacting with our website, you assent to the practices described in this Privacy Policy. InnerCircles reserves the right to change, modify, add, or remove portions of this Policy and relevant Terms at any time. If changes are made to this document, we will inform you by changing the ‘effective date’ of the Privacy Policy, including a notification within our web-app, and/or notifying web-app users via email.

Usage

InnerCircles collects information on your use of our web-app, such as dates and details pertaining to profile creation and user transactions (collaborations, experiences, subscribers, etc.).

Content & Messages

Any information or content that is uploaded/embedded by users to the public portions of their profiles will be visible to all users and web-app visitors. Whereas, content that is gated by a paywall, such as Subscriptions to exclusive content or Marketplace items, will only be visible to subscribers and purchasers. For administrative purposes, InnerCircles may access and view content behind users’ paywalls. Text-message correspondence between Creators, Brands (companies), and Fans (clients) – within message inboxes – is documented by InnerCircles for the purpose of upholding terms-and-conditions, with regards to acceptable use of the web-app, and mediating any discrepancies between users. Metadata associated with you profile content may also be collected by InnerCircles, such as file-size and post-dates.

InnerCircles may collect and document any additional information provided by users, through direct communications of phone calls or email correspondence with InnerCircles' employees or administrators. Some email communications may also include 3rd party links to identify and track which users have opened or interreacted with emails sent by InnerCircles.


Creators receiving payment for content/services via InnerCircles web-app will have access to the corresponding user's personal information obtained through Stripe (stripe.com) transactions, through connected Stripe-accounts. Depending on the type of transaction, this may include personal email, full name, company name, company website, and last 4-digits of credit/debit card.
Brands, Creators, Fans (clients) may receive personal information obtained through automated Stripe receipts that are received following in-app purchases. InnerCircles’ payment-settings are configured to include an InnerCircles email address on email-receipts, however most email-receipts must be personalized by users (creators) within Stripe’s dashboard. Creators are advised to adjust their personal Stripe-account settings to their preference to ensure their personal phone number or email are not provided to the end-users purchasing your content/services – in the form of an electronic payment receipt. Creators may choose whether to issue email-receipts for their transactions and select which personal information is included, via their Strip dashboard:

Usage

InnerCircles is not responsible for or answerable to personal information collected by any 3rd party website(s) associated with the app’s content/services. Users are hereby aware and agree that they may interact with or be redirected to 3rd party websites or services, through the use of our web-app, that may obtain personal information of which InnerCircles is not responsible for. Likewise, users hereby understand and agree that InnerCircles is not responsible for any personal information collected by 3rd parties. The details pertaining to the specific 3rd parties, outlined below, are intended for additional transparency and is not a complete list of all 3rd parties referenced above.


 InnerCircles provides two additional Login methods, by creating an account via Gmail or Facebook. Creating an InnerCircles profile, with one of these login options, requires that users have a Gmail or Facebook account. We are not responsible for any information collected by Facebook or Alphabet.


Huddle01 (huddle01.com) – InnerCircles has partnered with Huddle01 for meeting-link automation and livestream-events. Users [creators] that select ‘Huddle’ upon initiating a Live Call or Virtual Event will be subject to Huddle01’s Privacy Policy and applicable Terms & Conditions.


Stripe (stripe.com) – InnerCircles has partnered with Stripe for payment processing. Users [creators] must connect a Stripe account in order to receive payment through our web-app. All users are hereby advised that both InnerCircles administrators and Creators view personal information collected & documented by Stripe throughout the payment process. Depending on the type of transaction, this personal information may include personal email, full name, company name, company website, last 4-digits of credit/debit card, and details pertaining to the transaction (title of service provided, date of purchase, etc.) Any user participating in a payment transaction will be subject to Stripe’s Privacy Policy & Terms.

 Wix (wix.com) – our external website [about.innercircleapp.com, innercircles.online, etc.] is hosted on Wix.com. Whereby, InnerCircles has access to any data aggregated by Wix, such as general location demographics of website visitors or any personal information submitted via a website contact form.


 AWS – information and content uploaded or otherwise submitted to InnerCircles is hosted on bubble.io and AWS infrastructure. This information and content is accessible by InnerCircles’ direct and 3rd party administrators.

2. Information Collection Purposes

InnerCircles collects and processes personal information and content for the following purposes:


 Providing Services – we collect and process personal information that is necessary for the functionality of our web-app, such as public information provided and content upload to profiles. The use and presentation of personal information is also required to facilitate transactions through our web-app.


 Communication – the collection and processing of public information is necessary to facilitate communications between web-app users and for InnerCircles administrators to communicate with users, for the purposes of providing services and support.


 Marketing – InnerCircles endeavors to generate new business for the Creators using our web-app. In which, InnerCircles may promote users’ memberships or services. Whereby, we may feature creators or promote creators’ services to prospective brands. InnerCircles does not sell any information to 3rd parties and will not share any information that users have not made publicly available.


 Analytics – InnerCircles monitors app usage to observe how the web-app is being utilized, in order to make improvements to our web-app and services.


• Enforcing Terms-and-Conditions – public information provided by users may be processed and reviewed to prevent fraudulent activity, misconduct, or other unauthorized activities that are not compliant with our terms-and-conditions.


 Legal Obligations – InnerCircles may use and disclose personal information as permitted by law or in compliance with lawful requests, such as in response to subpoenas or court orders

3. Information Disclosure

InnerCircles permits access, shares, or otherwise discloses public information and content through the following practices:


Operations – users and visitors may access information that is made publicly available to them by InnerCircles’ users. Information or content may be shared with web-app users and InnerCircles administrators throughout web-app transactions between users.


Support – InnerCircles may disclose personal information and web-app transaction details with other users, system administrators, and 3rd parties, if necessary to resolve disputes or remediate technical difficulties.


Visitors – website & web-app visitors or non-account holders may view information and content that is made publicly accessible by users, unless access is restricted by creators (where permitted).


Promotion – In order to promote our web-app and generate opportunities for our community of creators, InnerCircles may share the web-app and user-profiles or public information thereof, with businesses or individuals through social media or direct communications. InnerCircles will not sell any personal information to 3rd parties and will not disclose any information for marketing purposes that has not been made publicly available by account-holders (users).


Service Providers – InnerCircles may disclose personal information with 3rd party service-providers that perform services on our behalf, such as hosting providers, payment processors, advisors, consultants, and technical resources.


Business Transfers – InnerCircles may share or transfer personal information upon evaluating or proceeding with business transfers, such as a sale, merger, or acquisition; or other change to InnerCircles’ business model that require the disclosure or transfer of data. Users will be notified accordingly should such an event transpire.


Legal Compliance – InnerCircles may be obliged to disclose personal information as permitted by law or in compliance with lawful requests, such as in response to subpoenas or court orders.

4. Rights and Choices

Below is a list of the rights and choices users have pertaining to the collection, processing, and disclosure of personal information.


 Personal Information – users have the right to update or delete public or personal information within their Profile Settings and throughout their Profile Page, such as their images, name, email, and multimedia content. Users may also choose to delete their account. However, InnerCircles may retain a copy of certain information that has been modified or deleted for the purposes of business operations, as permitted or required by applicable law.


 Marketing Communications – users may opt out of email marketing communications by clinking on corresponding unsubscribe links or contacting InnerCircles directly at kristen@innercirclesapp.com. Please be advised that InnerCircles may still send emails associated with web-app workflows & transactions or if necessary to communicate web-app or administrative updates. Users may also contact InnerCircles to request that we reframe from sharing a direct link to their profile or to remove any reference to their person, profile, or content across social media.  


 Transparency – users have the right to request and be informed of personal information that InnerCircles has collected pertaining to you and your web-app profile.


 Profile Preferences – InnerCircles has incorporated features to offer users more control over their public information. Creators may choose to ‘hide’ the pricing of their Collaboration services, by restricting access to other Creator & Brand profiles. In which, fans/clients and web-app visitors will be able to see your collab posts on your Profile Page and within our Marketplace, however they will not be able to view your pricing. Creators may choose to omit their personal name from Profile Page, by selecting their profile-handle to be displayed instead. Creators may choose to upload multimedia content, as either public or private; to restrict access to subscription-members only. Creators may determine whether to include personal information within Stripe email-receipts, through their Stripe dashboard: https://dashboard.stripe.com/settings/emails

5. Children Policy

Our web-app and services are not intended for any users under the age of 13. No one under the age of 13 is authorized to provide any personal information through our website, web-app, or services. We do not knowingly collect any personal information of children under the age of 13. If we learn that we have inadvertently collected personal information from a child under the age of 13, we will take steps to delete that information promptly.


Our ‘Creator Profiles’ – to receive payment on InnerCircles' web-app – require that users be at least 16 years of age. Users under the age of 18 years old are required to have permission from a legal guardian to use InnerCircles’ web-app or services. In accordance with our payment partner – Stripe – users under the age of 18 will be required (by Stripe) to have a legal guardian approve and sign off on their Stripe account. If you are a parent or legal guardian of a child under the age of 16, you are not permitted to grant Stripe approval to authorize an account associated with our web-app and services. If we learn that a Creator Profile is operated by a user under the age of 16, InnerCircles will terminate the account; regardless of approval from a legal guardian. Guardians of users that are under the age of 18 years old may be required to provide additional personal information for verification, such as First & Last Name, last four digits of Social Security Number, postal address, date of birth, a personal statement, and a copy of a personal ID. InnerCircles does not receive or document information provided through Stripe’s verification system.

6. Policy changes

This policy is effective as of the effective date of December 07, 2022. InnerCircles reserves the right to make changes to this policy. We will  inform active users of any changes to this policy by email, web-app, or website notifications. Users are advised to revisit this Privacy Policy periodically to review for any updates to the effective-date and policy terms.
